Terms & Conditions

These terms and conditions form the basis of the contract between our customer and Mrs Wiltshire. Payments to Mrs Wiltshire are deemed as acceptance of these terms.

·       Payment is accepted by bank transfer, or cash as agreed in advance for orders under £30. Orders over £100 require a deposit. Full payment must be made 2 weeks in advance of the order being collected / delivered. Mrs Wiltshire will not start making your cake, or ordering toppers/decorations, until payment is received in full. If payment is not received, your order will be cancelled and any deposit payment will not be returned.

·       All our cakes are fully labelled with information about when your cake was baked, how to store your cake, clear information on allergens, and if there are any non-edible items on the cake.

·       Some food colouring used by Mrs Wiltshire may have an adverse effect on attention and activity in children.

·       Responsibility for your cake passes to you once it has been collected from our premises or delivery has been accepted. Mrs Wiltshire accepts no liability for cakes that are damaged after they have been collected or delivered to the agreed location.

·       Upon collection, cakes should be transported on a flat surface (preferably in an empty car boot or passenger footwell) On hot days, we advise having the air-conditioning turned on during the journey to and from collection. Cake boxes should be carried carefully with 2 hands holding the base of the box. Refer to the cake label regarding refrigerating the cake.

·       Delivery is agreed in advance and subject to a delivery charge due in advance. Mrs Wiltshire will notify you of an approximate delivery time slot in advance. If there is no-one there to accept delivery, Mrs Wiltshire may agree to leave the cake in a safe, covered place, although this will not be suitable in hot weather. If delivery is attempted and there is no response on the doorbell and phone, the cake will be returned to Wylye and the customer will need to arrange a suitable time to collect it.

·       Our kitchen is not an allergy-free kitchen, and so we cannot guarantee that allergy-friendly cakes will not contain traces of wheat, eggs, milk and nuts, due to the nature of production. If a severe allergy is known, it is the customer’s responsibility to inform that guest not to eat the cake due to the possibility of trace allergens. Mrs Wiltshire accepts no liability for customers suffering allergic reactions from eating our cakes. Full lists of ingredients are available if requested on or before the day of collection/delivery.

·       Stacked cakes will be supported by dowels, which should be removed prior to serving, as well as any non-edible decoration as itemised on the label on the cake box.

·       All cake designs are the result of the information given to Mrs Wiltshire by the customer. This may be a specific brief with images provided by the customer, but we never fully replicate or copy someone else’s work, so your cake will be unique to you. Mrs Wiltshire reserves the right to make minor changes to best suit a design if they feel it is necessary, and these changes may not always be communicated to the customer.

·       Copyright and ownership of all cake designs by Jane Wiltshire remains with Mrs Wiltshire and we reserve the right to use photos of our cakes for advertising purposes including but limited to, on our website, Facebook page, social media and in other advertising materials.

 

Complaints

·       Complaints are very rare, however, Mrs Wiltshire takes them very seriously. You must let us know of any problems on the day of delivery, and send us relevant photos. Repairs and corrections to cake decoration can usually be corrected on the same day. No refunds will be given is the cake is not returned or has been eaten. At least 75% of the cake must be returned within 2 days to ensure we are able to assess the nature of the complaint. The maximum refund we offer is the value of the cake. Further compensation is not available.

·       Our liability to you is limited to the price of the cake and we cannot be held responsible for any indirect losses which may happen as a consequence of any breach by us of these terms however arising. However, this does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

·       We cannot be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond our reasonable control.

·       We have the right to revise and amend these terms and conditions. However, you will be subject to the terms and conditions in force at the time that you place your order with us.

Wedding Cakes

·       A non-refundable deposit of £100 is required to secure the date. The full balance for wedding cakes is due 4 weeks before the wedding date. If payment is not received in full, the cake will not be provided and your deposit will not be refunded.

·       Cake stands can be hired for £25+ for a day, plus a security deposit of £25+, as agreed on the quote. The security deposit will be refunded in full once the item is returned to Mrs Wiltshire on the agreed date, undamaged and in its original condition. If it is not returned or is damaged, this deposit will not be refunded.

·       It is the customer’s responsibility to ensure that a suitable, sturdy table is provided for the cake, and if the cake stand is provided by the customer or venue, it must be in place ready for the delivery time as agreed.

·       If you wish your wedding cake to be decorated with fresh flowers, it is best if the wedding florist provides flowers so that the cake matches the other floral arrangements. Please note that some flowers are not suitable for use as a cake decoration. Ask your florist for advice on toxicity as we cannot be liable for any contamination to your wedding cake that may arise.

·       Any amendments to your wedding cake design need to be made two months before the wedding date, and are subject to our approval. Significant amendments may incur an additional cost, and the balance will be adjusted accordingly.

·       In the event of a wedding postponement, if it is postponed more than 2 months prior to the wedding date, and if Mrs Wiltshire has availability on the new date, the deposit can be transferred and the remainder will be due 1 month before the new date. If Mrs Wiltshire is notified of the postponement less than 2 months prior to the wedding date, the deposit will not be refunded or transferred. Wedding cakes will only be postponed once. If the wedding is cancelled, the deposit will not be refunded. If the postponement or cancellation occurs after the final balance is paid, part of the payment may be refunded, or transferred to a new date, but all costs for work done and items ordered will be deducted.
